Whether an asset is part of the marital estate subject to equitable distribution by the court is a fact intensive question, and you don't provide enough information to give you a specific answer, however, generally any asset that starts or accumulates during the marriage is presumptively a marital asset subject to equitable distribution by the court, however it is a rebuttable presumption. Consult with an attorney to discuss the specifics of your situation and your options.

 Since your husband is in prison, did you have an opportunity to consummate the marriage?  Under Florida law, failure to consummate the marriage is one of the grounds for an annulment    Although there is not a specific Florida statute governing annulment, other grounds to petition the court for annulment include lack of capacity to contract for the marriage because one of the parties is already married, was intoxicated at the time of the marriage (by that, we mean intoxicated to the point of not knowing what one was doing), or did not have the mental capacity to enter into the marriage.  Other grounds include entering into the marriage by fraud or deceit. However, based on your circumstances, the lack of consummation may be your best bet.  Alternatively, you can file for divorce.  Since no children were born of the marriage, and since, presumably, there are no assets or liabilities to divide, Florida statutes guaranty that you can get divorced.    Good luck,    Cindy Vova    Law Office of Cindy S. In Nebraska, being served with divorce papers starts two important deadlines: 30 days for you to file an Answer to protect your rights and ensure she does not get a default divorce where she receives everything she requests; and 60 days for the waiting period to expire (so that a hearing can be held). If you have children, you must comply with the Parenting Act, including completing and filing a certificate for the co-parenting class and mediation if you do not agree on custody/parenting time.
