Can the grandparents get custody in florida when parents are divorced

Blair Henry Chan
Answered by attorney Blair Henry Chan (Unclaimed Profile)
Divorce lawyer at Blair H. Chan, III, PLLC
A family member can get temporary custody of a child under section751.  It is referred to as Temporary Custody by Extended Family.  To get custody over the other parent, the parent must consent in writing to give you custody or you need to have a hearing and prove they are an unfit parent.

What rights do I have if my husband kicked me out of the house after 23 years of marriage, would not allow me to take our 13 year old daughter?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
You don't indicate what the reason was for your husband's behavior, but generally, in a long term marriage like yours, the court will equitably distribute all of the marital assets and liabilities between the both of you. You may possibly have an alimony claim, and timesharing with your daughter will be determined by a number of factors, most importantly, what's in her best interest, and there will be a determination of child support. Depending on each of your incomes, you may also have a claim for your attorney's fees and costs. You should consult with an attorney as soon as possible.

I got divorced six years ago, is it possible to have it changed to an annulment?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
After six (6) years since your final judgment was entered, it is unlikely that you can obtain an annulment. However, you may be able to obtain a religious annulment through your church. You should consult with your clergyman regarding this.
