QDRO

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
You pose a question that I would typically answer in the affirmative. I suspect what you really want to know is if your pension amount is going down (monthly payments?) does this reduce the amount your former spouse is to receive.  When a QDRO divides a  pension that the participant is going to receive into the future, how much of that the former spouse will receive and whether that will change depends on how the QDRO is worded.      Read over the language that deals with what your former spouse is to receive.  If it is worded as a percentage of the total payment, then it should adjust accordingly in the event your pension goes down....or up.      I hope you had this covered when you divorce. Best wishes, Cindy Vova Law Office of Cindy S. Vova, P.A. 8551 West Sunrise Blvd., Suite 301 Plantation, FL 33322 info@vovalaw.com 954-316-3496

How do I get him to pay half of certain credit card debts as per the divorce judgment?

default-avatar
Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
If there is an order for him to pay half and he hasn't file a motion for enforcement to quantify the amount and get a judgment just on the amount. Then enforce the judgment.

Can I still receive part of my husband's pension if we divorce in another state?

default-avatar
Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
Without knowing what states you're talking about, it's rather impossible to answer your question specifically. Generally, if you have been living as husband and wife in Florida for more than 6 months, Florida will generally have jurisdiction over your divorce. In FL, you may be eligible for one or more types of alimony, including permanent alimony, depending on the facts of your case. Additionally, FL is an equitable distribution state, so you would generally each be entitled to presumptively half of the marital assets and liabilities, which would generally include half of the marital portion of the retirement benefits. However, certain police officer and firefighter pensions are exempt from Qualified Domestic Relations Orders issued by the family court in a divorce case, but there are other ways to compensate you for your half interest in the marital portion of his pension. Consult with an attorney to discuss the specifics of your situation and your options.
