When an engagement is broken off, who is entitled to the engagement ring?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
Generally speaking, the engagement ring is a gift "in contemplation of marriage." If the marriage occurs and is then dissolved, the recipient keeps the ring. If the marriage never occurs, the ring should be returned to the person who gave it.

What will happen at a final divorce hearing if my spouse refuses to come?

Answered by attorney Charles D. Scott (Unclaimed Profile)
Divorce lawyer at The Law Offices of Charles D. Scott PLLC
The answer to what will the judge do is as follows: "what does a 300 pound bear do?"  the answer: "anything he wants to do".  I cannot predict what the court will do in your case. If you have proof that your husband is lying about not being able to appear, and instead is going to a wedding, I suggest you go to the hearing, let your husbands lawyer make excuses, then show the judge your proof of where your husband really went.  Ask the judge to go forward with the divorce and issue a final judgment because it is prejudicial to you if your husband misleads the court, and your hearing is postponed as a result. The court can at the very least dissolve the marriage, and at best possibly make substantial rulings in your favor if the judge is put off by your husbands failure to appear and lying about why he has not appeared.

Under what circumstances a divorce would be granted in a 21 year marriage when a partner abandons the other?

Divorce lawyer at R. Jason de Groot, P.A.
You have to be served with a petition for dissolution, usually either by the sheriff's department or perhaps a private process server. The documents have to be handed to you or someone over the age of 15 who resides in the same home.
