Florida has an abbreviated procedure for "simplified" divorce proceedings when there are no minor or dependent children, and the parties have made a satisfactory division of their assets and liabilities.  Such a divorce proceeding must be filed jointly by the parties, and both parties must appear in court for a final hearing.  If these requirements cannot be met, then the conventional procedures for divorce proceedings must be followed.  One spouse would file for divorce on their own and serve the other party.  After various procedural and legal steps are completed, the divorce can be set for final hearing where it would not be required that both parties attend.

You should have representation by a family law attorney with experience in representing divorcing spouses with closely-held businesses, especially real property. A "Lis Pendens" is a document that gets recorded in the public records against specific parcels of real property that puts the world on notice that there is litigation pending that may impact the real property, and/or interests in the real property. The practical effect of a Lis Pendens is that it makes it unlikely that you can sell, mortgage, pledge, transfer, etc., the real property until the litigation is resolved, you reach an agreement as to all or some of the real properties, or you obtain a court order dissolving or lifting the Lis Pendens. Consult with an attorney about the specifics of your situation, and your options.
